Service Provider Agreement

This Service Provider Agreement ("Agreement") forms part of the BuildPeek Terms of Service and sets out additional terms that apply to users who register as Service Providers on the BuildPeek platform.

1. Eligibility

To become a Service Provider, you must: (a) be at least 18 years of age; (b) have a completed build, renovation, extension, or granny flat that you own or have lawful authority to list; (c) have a valid Australian bank account linked via Stripe for receiving payments; and (d) agree to these terms by ticking the consent checkbox during the sign-up process.

2. Accuracy of Information

You represent and warrant that all information you provide about your property is truthful, accurate, and complete. This includes but is not limited to the property address (suburb), project type, build or renovation cost, builder or contractor details, year completed, and any description or features listed. Providing misleading or false information may result in immediate removal of your listing and suspension or termination of your account.

3. Content Ownership and Licence

You represent that you own or have all necessary rights, licences, and permissions to upload and share all content (including photos, videos, virtual tours, and descriptions) you submit to BuildPeek. By uploading content, you grant BuildPeek a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, modify, and distribute the content solely for the purpose of operating and promoting the BuildPeek platform. You retain ownership of your content and may request its removal at any time by deleting your listing or contacting us.

4. Content Standards

All content you upload must:

  • Be relevant to your property listing and building/renovation experience
  • Not contain personally identifiable information of any person (including personal documents, licence plates, mail with visible addresses, or photos of identifiable individuals without their consent)
  • Not infringe the intellectual property, privacy, or other rights of any third party
  • Not contain offensive, defamatory, discriminatory, or unlawful material
  • Be of reasonable quality (clear images, stable video, adequate lighting)

BuildPeek reserves the right to reject or remove any content that does not meet these standards.

5. Review and Approval

All property listings are subject to review and approval by the BuildPeek team before being published on the platform. We may request changes to your listing or additional information before approval. BuildPeek reserves the right to reject any listing at its sole discretion, including but not limited to listings that do not meet our quality standards, contain inaccurate information, or violate these terms.

6. Pricing and Platform Fees

You set your own prices for virtual tours and video consultations. BuildPeek charges a platform fee of 25% on each completed transaction. The remaining 75% is transferred to your Stripe-connected bank account. You are responsible for any taxes, including GST, applicable to your earnings. BuildPeek does not provide tax advice and recommends consulting a qualified tax professional.

7. Stripe and Payments

To receive payments, you must connect a valid Stripe account. By doing so, you agree to Stripe's Connected Account Agreement. BuildPeek is not responsible for any issues relating to your Stripe account, including delays in fund transfers, account holds, or Stripe's identity verification requirements.

8. Virtual Tours

When a Buyer purchases a virtual tour, they receive immediate digital access to your uploaded video or virtual tour content. As this is a digital product delivered instantly, virtual tour purchases are generally non-refundable once accessed, except as required by Australian Consumer Law.

9. Video Consultations

If you offer video consultations, you agree to:

  • Maintain accurate availability windows on your profile
  • Respond to consultation booking requests in a timely manner (within 48 hours)
  • Attend scheduled consultations at the agreed time
  • Provide helpful, honest, and relevant information during consultations

If you decline a consultation request, the Buyer will receive an automatic full refund. Repeatedly declining requests or failing to attend confirmed consultations may result in restrictions on your account or removal of the consultation feature.

10. No Professional Advice

You acknowledge that the information and experience you share through BuildPeek constitutes personal opinion and experience only. You must not represent yourself as providing professional building, architectural, engineering, financial, or legal advice unless you hold the relevant professional qualifications and licences. You should encourage Buyers to seek independent professional advice before making decisions.

11. Refunds and Disputes

BuildPeek handles refunds in accordance with the Refund Policy and Australian Consumer Law. You acknowledge that BuildPeek may issue refunds to Buyers in certain circumstances, including where a consultation is declined, the content does not match the listing description, or a legitimate dispute is raised. In such cases, the refund amount (including the platform fee) will be deducted from your Stripe account or future earnings.

12. Liability and Indemnification

You are solely responsible for all content you upload and all services (including consultations) you provide through BuildPeek. You agree to indemnify and hold harmless BuildPeek from any claims, damages, losses, or expenses arising from your listings, content, advice, or conduct on the platform. BuildPeek acts as a marketplace only and does not inspect, verify, or endorse any property or service listed.

13. Suspension and Termination

BuildPeek reserves the right to suspend or terminate your Service Provider status at any time for violation of this Agreement, the Terms of Service, fraudulent activity, persistent negative feedback from Buyers, or any conduct that we determine to be harmful to the platform or its users. Upon termination, your listings will be removed and any pending payouts will be processed subject to Stripe's terms.

14. Amendments

BuildPeek may update this Agreement from time to time. We will notify you of material changes via email or through the platform. Your continued use of BuildPeek as a Service Provider after any changes constitutes acceptance of the updated Agreement.

15. Governing Law

This Agreement is governed by the laws of the State of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
