1. About BuildPeek

BuildPeek ("we", "us", "our") is an online marketplace that connects homeowners who have completed builds or renovations ("Service Providers") with prospective buyers, builders, and renovators ("Buyers") seeking to learn from real-world building and renovation experiences. BuildPeek is operated in Australia and these terms are governed by the laws of the Commonwealth of Australia.

2. Acceptance of Terms

By accessing or using BuildPeek, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the platform. We may amend these terms at any time by posting the revised version on this page. Your continued use of BuildPeek after any changes constitutes acceptance of the updated terms.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract under Australian law to use BuildPeek. By creating an account, you represent and warrant that you meet these requirements.

4. Account Registration

To access certain features of BuildPeek, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

5. The BuildPeek Marketplace

BuildPeek acts solely as an intermediary marketplace. We do not own, build, renovate, or inspect any properties listed on the platform. We do not provide building, renovation, financial, or legal advice. All content, virtual tours, consultations, and services are provided by independent Service Providers, and BuildPeek does not endorse, guarantee, or verify the accuracy, quality, or safety of any listing, content, or advice.

6. Service Providers

Users who wish to list properties and offer virtual tours or video consultations must apply to become a Service Provider and agree to the Service Provider Agreement. Service Providers are responsible for the accuracy of their listings, the quality of their content, and compliance with all applicable laws. All listings are subject to review and approval by BuildPeek.

7. Buyers

Buyers may browse approved property listings and purchase virtual tours or video consultations. By purchasing a service, you acknowledge that you are paying for access to informational content and personal experience sharing only. The information provided by Service Providers does not constitute professional building, renovation, financial, or legal advice.

8. Payments and Fees

All payments are processed securely through Stripe. Prices are set by Service Providers and displayed in Australian Dollars (AUD). BuildPeek charges a platform fee of 25% on each transaction, which is deducted before the remaining amount is transferred to the Service Provider. By making a purchase, you agree to Stripe's terms of service. BuildPeek does not store your credit card or payment details.

9. Refunds

Refunds are handled in accordance with our Refund Policy and Australian Consumer Law. Virtual tour access is delivered digitally and is generally non-refundable once accessed. For video consultations, if a Service Provider declines or fails to fulfil a booking, a full refund will be issued automatically.

10. Intellectual Property

All BuildPeek branding, design, and platform code are owned by BuildPeek. Content uploaded by Service Providers (photos, videos, descriptions) remains the intellectual property of the respective Service Provider. By uploading content, Service Providers grant BuildPeek a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the content for the purpose of operating the platform.

11. Prohibited Conduct

You must not:

  • Provide false, misleading, or fraudulent information
  • Upload content that infringes the intellectual property rights of any third party
  • Upload content containing personally identifiable information of others without consent
  • Use the platform for any unlawful purpose
  • Attempt to circumvent the platform to arrange direct payments with Service Providers
  • Interfere with or disrupt the operation of the platform
  • Create multiple accounts or impersonate another person

12. Limitation of Liability

To the maximum extent permitted by law, BuildPeek is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. BuildPeek's total liability to you for any claim arising out of or relating to these terms or the platform shall not exceed the amount you paid to BuildPeek in the 12 months preceding the claim. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

13. Indemnification

You agree to indemnify and hold harmless BuildPeek, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of the platform, your breach of these terms, or your violation of any applicable law.

14. Termination

BuildPeek may suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these terms, is harmful to other users, or is otherwise inappropriate. You may delete your account at any time by contacting us.

15. Dispute Resolution

Any dispute arising out of or relating to these terms shall be governed by the laws of the State of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
